NBA criticises rivers administrator over alleged disregard for rule of law

The Nigerian Bar Association (NBA), Port Harcourt Branch, has strongly criticized the conduct of Vice Admiral Ibok-Ete Ibas (rtd), the Sole Administrator of Rivers State, accusing him of violating the constitution and undermining democratic governance in the state.

In a press statement issued by the Body of Chairmen of Rivers State, signed by the 8 Branch Chairmen, the NBA expressed deep concern over the actions that have transpired under the sole administration model, which was implemented after a state of emergency was declared.

The lawyers’ body condemned the interference with constitutionally guaranteed structures, including the suspension of elected state officials and the recent appointments made by the Sole Administrator. The NBA described these actions as unlawful, provocative, and damaging to democratic institutions. The statement highlighted that the actions of the Sole Administrator violated both the spirit and the letter of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).

The NBA emphasized that as a body committed to upholding the rule of law, it could not remain silent while constitutional order was being disregarded. It warned that the ongoing situation posed a threat to Nigeria’s democratic system and could erode public trust in governance and the legal system. The statement also raised concerns about the alleged harassment and intimidation of citizens, particularly those who have criticized the state of emergency or attempted peaceful protests.

In a clear appeal to President Bola Tinubu, the NBA called for an immediate review and reversal of the emergency governance framework in Rivers State. It demanded the reinstatement of Governor Siminalayi Fubara and other duly elected officials, emphasising that the people’s mandate must not be disregarded. The NBA reiterated that the democratic will of the people is sacrosanct and must be respected by all relevant institutions.

The Association concluded by reaffirming its commitment to democratic values, constitutionalism, and peaceful conflict resolution. It cautioned that legitimising or normalising administrative actions that override the constitution could set a dangerous precedent for governance across Nigeria. The NBA’s strong stance signals a growing resistance from civil society and professional bodies against what they perceive as a gradual erosion of democratic norms in the country.
